Thank you for choosing Moss & Associates, Attorneys, P.A. to assist in your bankruptcy matter.  We understand that filing for bankruptcy is not only very important but is often a very stressful time in your life.  Please know that we strive to make the process as smooth as possible.  We would like to take this opportunity to explain how our office works and hopefully answer questions you may have about the bankruptcy process. 

In order for us to file your case with bankruptcy court, you will need to complete the questionnaire and pay the fee soutlined in your payment schedule provided during your initial consultation.  Please be thorough completing your questionnaire ensuring that you list all of your creditors and answer all of the questions.  Our offices, located in Columbia, Greenville, and Charleston, SC, have trained intake specialists on staff to assist you.  They will provide support in completing your questionnaire and collecting all the documents necessary to prepare your bankruptcy petition.  They are available to meet with you during office hours, no appointment needed.

The questionnaire is available on the internet.  If you would prefer to complete questionnaire online, please call the office and one of our intake specialists will assist you in getting started.  To begin, you must have a valid email address.  Once registered, a user name and password will be sent to your email address.  Once received, please visit the secured website: https://www.mycaseinfo.com/Client/ to complete your questionnaire at your own pace.

Our intake specialists are available to help you request your credit reports or tax transcripts.  You may also visit the secured website https://www.myhorizontoday.com/ .

Our intake specialists will make an appointment for you to come to the office to meet with your experience caseworker and sign your completed case.  Your caseworker will review all documents to be filed with the bankruptcy court and provide you with a copy of everything you signed.  All of your creditors will receive written notices by mail informing them of your bankruptcy filing.  They will not be allowed to contact you for any reason.  

You will be required to attend a short hearing between 30 to 45 days after your filing.  The court will send you a notice with the exact time and date of the hearing and our office will call you to confirm your attendance.  This is an informal meeting in which the bankruptcy trustee and any creditor in your case have the opportunity to ask you brief questions.  One of our attorneys will accompany you to this meeting, known as the ‘341 Hearing’ or ‘Meeting of Creditors’.
